قبلت المحكمة العامة في الإتحاد الأوربي سماع دعوى المدعي، الفريق الأول الركن عبد الواحد شنان آل رباط، التي أقامها ضد المفوضية الأوربية، المدعى عليه. وكانت المفوضية الأوربية قد رفضت، خلافا للمادة 265 من معاهدة الإتحاد الأوربي (معاهدة لشبونة)، التحقيق في تجاوز الحكومة البريطانية على حقوق المدعي والتي حفظها القانون الأوربي حين رفضت المحكمة العليا في لندن يوم 31 تموز 2017 السماح للمدعي بمباشرة دعوى ضد توني بلير وأعضاء من حكومته بتهمة جريمة العدوان في غزو العراق عام 2003 والتي كان المدعي أحد ضحاياها.

Crime of Aggression on Iraq Reaches European Court

The General Court of the European Union (GC) has accepted the complaint lodged by the Applicant, General Abdul Wahed Shannan Al Rabbat, against the Commission of the European Union, the Respondent, for the failure of the latter, contrary to Article 265 TFEU, to investigate the infringement of the Applicant’s rights by the UK Government in the judgment of the High Court in London of 31 July 2017 denying the Applicant the right of access to justice in initiating criminal proceedings against Tony Blair and members of his Government for the crime of Aggression in invading Iraq in 2003.
